On April 21, 2023, the Administrative Judge assigned to this case issued a decision certifying the class. The Agency appealed the decision and on August 30, 2023, the EEOC denied the Agency's appeal. Therefore, women who fit within the class definition above will be allowed to pursue their claims together before an Administrative Judge at the EEOC. The lawyers whom the Administrative Judge appointed to represent the class will argue to the Administrative Judge that the Agency’s conduct violated federal law. In the event the Administrative Judge finds the Agency’s actions violated the law, then each member of the class will have the opportunity, if they wish, to come forward to make a claim for damages caused by being placed on Temporary Light Duty because of pregnancy.

An EEOC Administrative Judge has allowed women at Customs and Border Protection who fit within the definition below to bring your claims together to seek monetary relief for harm you may have suffered for being placed on Temporary Light Duty because of your pregnancy. You are automatically a member of the class if you fit within the definition below:
All women who were employed as U.S. Customs and Border Protection (“CBP”) Officers and Agriculture Specialists and were placed on temporary light duty pursuant to CBP’s Temporary Light Duty Policy due to their pregnancy, at any time after July 18, 2016.
